Terms of service

These terms govern the use of DIGO Express, a service provided by Studio 09 S.r.l., with registered office at Via Pietro Borgognoni 15, 51100 Pistoia (PT), VAT number 01710080472, email info@studio09.it (“Studio 09” or “we”).

1. The service

DIGO Express lets you upload files and share them via a link or by email. Whoever receives the link downloads the files without signing up. Files remain available until the chosen expiry date and are then permanently deleted: DIGO Express is not a storage or backup service, and senders must keep their own copy.

2. Free plan and Pro

On the free plan you can send up to 5 GB per transfer, with a link valid for 7 days, to up to 3 recipients and with 10 transfers per day, after verifying your email address with a code. Pro is a monthly or annual subscription that adds transfers of up to 2 TB, links lasting up to 90 days, passwords, download limits, notifications, statistics, a custom download page and “Request files”. The limits that apply are those shown on the website at the time of the transfer.

Enterprise is a monthly or yearly subscription that includes everything in Pro and adds transfers with no size limit (a single file stays within about 9.7 TB because of the storage’s technical limits), a different brand for each transfer and sends scheduled by date and time. The same terms as Pro apply to Enterprise.

3. Acceptable use

Senders are solely responsible for the files and messages they upload, and warrant that they have the right to do so. You may not use DIGO Express for:

• illegal content, including child sexual abuse material, incitement to violence or terrorism, and defamatory content;
• files that infringe copyright, trademarks or other third-party rights;
• viruses, malware, phishing, scams or files that deceive their recipients;
• personal data of third parties without a valid legal basis;
• spam, automated transfers or uses that overload the service or circumvent its limits.

We may block a transfer, delete its files and suspend an account when we receive a well-founded report, when the law or an authority requires it, or when we have concrete evidence of a violation. We inform the sender, stating the reason, unless the law prohibits it.

4. Reports

Anyone can report illegal content using the “Report abuse” link on every download page or by writing to info@studio09.it, as described on the Report abuse page, which is also our point of contact under Regulation (EU) 2022/2065 (Digital Services Act).

5. Pro subscription and payments

Pro is paid in advance through Stripe, by card or with other methods offered at checkout; we do not store card details. Prices are in euros, including VAT where applicable. The subscription renews automatically at the end of each period until it is cancelled: you can cancel at any time from your dashboard, and Pro remains active until the end of the period already paid for, with no refunds for unused portions. We may change prices with at least 30 days’ notice by email; new prices apply from the next renewal.

Consumers. Anyone buying as a consumer has 14 days to withdraw from the contract. By asking for Pro to be activated immediately, they agree that, if they withdraw, the amount for the period already used will be retained.

6. Availability and liability

We do our best to keep the service running at all times, but we do not guarantee that it will be free of interruptions or errors. To the extent permitted by law, we are not liable for loss of files, indirect damage or loss of profits; this does not affect liability for wilful misconduct or gross negligence, or consumers’ mandatory rights. Senders shall indemnify Studio 09 against third-party claims arising from their content.

7. Account

You sign in with a code sent by email: anyone with access to the mailbox has access to the account. You can delete the account at any time from your dashboard; when it is deleted, we delete its transfers and download page and cancel Pro.

8. Changes

We may change these terms for justified reasons (law, security, development of the service). We notify registered users by email at least 30 days in advance.

9. Governing law and jurisdiction

Italian law applies. Disputes with business customers fall under the jurisdiction of the courts of Pistoia; for consumers, the courts of their place of residence.
